Welcome to Neutral Pilates Inc. These Terms of Service ("Terms") govern your use of the Neutral Point mobile application (the "App") operated by Neutral Pilates Inc. ("we," "us," or "our"). By creating an account or using the App, you agree to be bound by these Terms. If you do not agree, please do not use the App.
Neutral Point is a unified booking and membership platform that allows you to discover, book, and manage Pilates classes across multiple Neutral Point studio locations in the Greater Toronto Area. The App provides class scheduling, session-based booking, membership management, a loyalty points program, coach reviews, and training content.
Our current studio locations include Downtown Toronto, North York, Richmond Hill, Markham, and Pilates 8. Locations may be added or changed at our discretion.
You must be at least 13 years of age to create an account. If you are under 18, you represent that you have obtained parental or guardian consent to use the App.
You are responsible for maintaining the confidentiality of your account credentials. You agree to notify us immediately of any unauthorized use of your account. We are not liable for any loss resulting from unauthorized access to your account.
You agree to provide accurate, current, and complete information during registration and to keep your account information updated.
All prices are listed in Canadian Dollars (CAD) unless otherwise stated. We reserve the right to change pricing for session packages and memberships at any time. Price changes will not affect session packages or membership periods already purchased.
We reserve the right to modify class schedules, substitute instructors, or cancel classes due to unforeseen circumstances. If we cancel a class, sessions used for that booking will be refunded to your account.
The App includes a loyalty points program that rewards you for certain activities such as booking classes, purchasing session packages or memberships, and signing up for an account. Points can be redeemed for rewards as described below.
All payments are processed securely through Stripe, our third-party payment processor. By making a purchase, you agree to Stripe's terms of service.
Refund eligibility is determined on a case-by-case basis. To request a refund, please contact us at the email address provided in Section 15. Refunds, where approved, will be issued to the original payment method.
Applicable taxes (including HST) will be calculated and displayed at checkout. You are responsible for any taxes imposed on your purchases.
Certain purchases and subscriptions may be offered through Apple's App Store or Google Play. These transactions are subject to the terms and billing policies of the respective platform providers. Neutral Pilates Inc. is solely responsible for the services provided through the App. Apple Inc. and Google LLC are not responsible for the content, services, or transactions within the App. Refunds for purchases made through Apple App Store or Google Play are subject to their respective refund policies.
You may submit a review for a coach only after attending a class taught by that coach. Each member may submit one review per coach, which may be updated at any time.
Reviews must be based on your genuine experience. Reviews must not contain abusive, discriminatory, defamatory, or inappropriate language, personal attacks, or content unrelated to your class experience.
We reserve the right to remove or edit reviews that violate these standards, without prior notice. We are not obligated to publish or retain any review.
All content, features, and functionality of the App — including but not limited to text, graphics, logos, icons, images, training content, videos, and software — are the property of Neutral Pilates Inc. or its licensors and are protected by Canadian and international copyright, trademark, and other intellectual property laws.
You may not reproduce, distribute, modify, create derivative works of, publicly display, or otherwise exploit any content from the App without our prior written consent.
Pilates and other physical fitness activities involve inherent risks of injury. By booking and attending classes through the App, you acknowledge that you participate at your own risk. You are responsible for consulting with a qualified healthcare provider before beginning any exercise program.
The App is provided on an "as is" and "as available" basis. We make no warranties, express or implied, regarding the App's reliability, availability, accuracy, or fitness for a particular purpose.
Neutral Pilates Inc. operates as a booking platform that connects you with independently operated Pilates studios. We are not responsible for the quality, safety, or suitability of classes, instruction, equipment, or facilities provided by any studio. Any disputes regarding the services received at a studio should be directed to that studio. Your use of any studio's services is at your own risk.
The App relies on third-party services (including but not limited to Stripe, Wix, and Mindbody) for payment processing, class scheduling, and booking management. We are not liable for any service interruptions, booking failures, data delays, or inaccuracies caused by the unavailability or malfunction of these third-party systems. In the event of a booking failure due to a third-party system issue, any sessions consumed will be refunded to your account.
To the fullest extent permitted by law, Neutral Pilates Inc. and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the App, including but not limited to personal injury, loss of data, or loss of sessions or points.

You may delete your account at any time through the App's account settings or by contacting us. Upon account deletion, we will delete or anonymize your personal data within 30 days, except where retention is required by law.
We reserve the right to suspend or terminate your account at our discretion, with or without notice, for conduct that we determine violates these Terms, is harmful to other users or our business, or for any other reason.
Upon termination, your right to use the App ceases immediately. Any sessions, loyalty points, or unredeemed rewards remaining in your account at the time of termination may be forfeited, except where prohibited by applicable law.
These Terms are governed by and construed in accordance with the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict of law principles.
Any disputes arising from or relating to these Terms or your use of the App shall be resolved through good-faith negotiation. If a dispute cannot be resolved through negotiation, it shall be submitted to the exclusive jurisdiction of the courts of the Province of Ontario, located in Toronto.
We may modify these Terms at any time. When we make material changes, we will notify you through the App or by other reasonable means. Your continued use of the App after the effective date of any changes constitutes your acceptance of the revised Terms.
If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
